West Northamptonshire Development Corporation
The Corporation was established by the West Northamptonshire Development Corporation (Area and Constitution) Order 2004 for the purpose of regenerating three areas in West Northamptonshire (Northampton, Daventry and Towcester), which it designated as an urban development area (UDA).
The West Northamptonshire Development Corporation (Planning Functions) Order 2006 provided for the development corporation to be the local planning authority, in the “central planning functions area” in Northampton Town Centre, for broadly all kinds of development (except that relating to households). It also provided for the Corporation to be the local planning authority for those purposes in the “outer planning functions area”, in relation to specified kinds of developments, broadly “strategic development”.
In January 2010 the Government announced the outcome of its Five Year Review of the West Northamptonshire Development Corporation (WNDC).
The review recognised that the Development Control decision-making powers held by WNDC should be returned to the relevant local planning authorities (Northampton Borough Council, Daventry District Council, South Northants District Council and Northamptonshire County Council). The Government will therefore provide for planning responsibilities to be returned on a staged basis. The first stage will be to raise the threshold for residential planning applications determined by WNDC from 50 homes to 200 homes, return ‘other’ applications in the Northampton Central Planning Area to Northampton Borough Council; and return Waste and Minerals applications to Northamptonshire County Council.
Although it remains subject to Parliamentary assent, it is anticipated that the revised powers will come into effect on 1 April 2011.
Subject to the parliamentary process, all live and determined applications below the new thresholds will be transferred from WNDC to the relevant local planning authority on the 1 April 2011 to deal with as the local planning authority. WNDC will then deal with all applications and associated submissions above the revised thresholds after this date.
